3. What is Betting?

Betting is a commonly used concept in developed countries such as the US and UK, where activities like horse racing and dog racing are legal. Participants in betting can freely choose to place their bets (wagers) on various outcomes.

Betting can be defined as:

"Betting is an agreement in which participants wager on the correctness or failure of a prediction, or on the successful or unsuccessful completion of a challenge, for financial or material gain, in any form, and is considered an organized gambling activity."

Any form of betting, regardless of its nature or extent, is deemed to be an act of organized gambling or gambling. Depending on its nature and scale, it may be subject to administrative penalties or criminal prosecution under the law.

4. Is Sports Betting a Form of Gambling?

According to Article 1, Clause 4 of Resolution No. 01/2010/NQ-HĐTP, Guidelines for the application of Articles 248 and 249 of the Penal Code on gambling, sports betting falls under the category of illegal gambling.

"If gambling takes the form of playing lottery, betting on sports, or horse racing (considered gambling once lottery, sports betting, horse racing are played), it is understood as participating in a lottery, betting on sports, or horse racing (playing in a lottery, sports betting, horse racing), in which players can play multiple rounds. Criminal liability is determined for the player's total amount of money and the value of the artifacts used to play in those rounds."

Therefore, sports betting is also an act of gambling and is subject to sanctions and penalties.

5. Administrative Penalties for Sports Betting

According to Article 26 of Decree No. 167/2013/NĐ-CP:

"Illegal gambling behavior

  1. Warning or fines from 200,000 to 500,000 dong for buying lottery numbers, lottery tickets.

  2. Fines from 1,000,000 to 2,000,000 dong for any of the following gambling behaviors:

a) Illegal gambling such as dice, baccarat, poker, crab crab, tam cuc, 3 plants, four colors, red-black, chess, or other forms of winning, material;

b) Gambling with machines, illegal electronic games;

c) Betting with money or other forms of gambling in sports, entertainment, other activities;

d) Selling tables, other publications for lottery, lottery.

  1. Fines from 2,000,000 to 5,000,000 dong for any of the following gambling behaviors:

a) Deposit of money, pawn, loan in casinos, other gambling places;

b) Concealment of illegal gambling.

  1. Fines from 5,000,000 to 10,000,000 dong for any of the following gambling activities:

a) Recruiting, attracting, gathering others to participate in illegal gambling;

b) Using homes, other places, means, other locations to gamble;

c) Placing slot machines, illegal electronic games;

d) Organizing betting for illegal money.

  1. Fines from 10,000,000 to 20,000,000 dong for any of the following gambling activities:

a) Mastering lottery, lottery;

b) Organizing production, publishing of lottery numbers, other publications for lottery, lottery;

c) Organizing a network to sell lottery numbers, lottery;

d) Organizing gambling in sports, entertainment activities or other activities to gamble, win money.

  1. Additional sanctions:

Seizure of property, administrative penalty vehicles, and seizure of money for administrative offenses for violations of the provisions of Paragraph 1; Paragraph 2; Point a Paragraph 3; Point b, c, d Paragraph 4 and Paragraph 5 of this Article.

  1. Foreigners committing administrative offenses specified in Clauses 1, 2, 3, 4, and 5 of this Article may be subject to deportation penalties from the Socialist Republic of Vietnam. ”

6. Criminal Liability for Sports Betting

When sports betting involves all elements of gambling, criminal liability for gambling offenses will be prosecuted under Article 321 of the 2015 Penal Code:

Gambling

  1. Anyone who illegally gambles in any form of money or material assets valued from 5,000,000 to less than 50,000,000 dong or less than 5,000,000 dong, has been administratively fined for violating this act or violating the provisions of Article 322 of this law or being sentenced to this crime or the offense specified in Article 322 of this law, is not yet cleared of the offense but still violates it, shall be sentenced to reform without imprisonment for up to 03 years or imprisoned for 06 months to 03 years.

  2. The offense falls into one of the following cases, it is imprisoned from 03 years to 07 years:

a) Professional nature;

b) Money or material assets used for gambling worth 50,000,000 dong or more;

c) Using the internet, computer networks, electronic networks, electronic devices to commit crimes;

d) Dangerous relapse.

  1. Offenders may also be fined from 10,000,000 to 50,000,000 dong. ”
